This Privacy Policy outlines the rules for the processing of personal data collected through the techtag.pl online store (hereinafter: "Online Store").

The administrator of the Customer's personal data, in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter as GDPR), is TECHTAG Spółka z ograniczoną odpowiedzialnością (LLC), based at Stawki 8, unit U9, 00-193 Warsaw, VAT ID: 9662144151, REGON: 387303143, registered in the National Court Register (KRS) under number 0000865160, hereinafter referred to as TECHTAG.

Personal data collected by TECHTAG via the Online Store are processed in accordance with the General Data Protection Regulation (GDPR).

TECHTAG exercises special care to respect the privacy of Customers visiting the Online Store.

§ 2 Types of Processed Data, Purposes, and Legal Basis

1. TECHTAG collects information regarding natural persons conducting business or professional activity in their own name, and natural persons representing legal entities or organizational units without legal personality, to which the law grants legal capacity, hereinafter collectively referred to as Customers.

2. Customers' personal data are collected in the case of:

• a) registering an account in the Online Store to create and manage an individual account and place orders. Legal basis: necessity for the performance of a contract (Art. 6 sec. 1 lit. b GDPR);
• b) subscribing to the newsletter, to perform a contract whose subject is a service provided electronically. Legal basis: consent of the data subject to perform the Newsletter service contract (Art. 6 sec. 1 lit. a GDPR);
• c) using the "ask about a product" service to perform a contract whose subject is a service provided electronically. Legal basis: necessity for the performance of the "ask about a product" service contract (Art. 6 sec. 1 lit. b GDPR);
• d) Customer satisfaction surveys. Legal basis: necessity for the purposes of the legitimate interests pursued by TECHTAG, consisting in ensuring and maintaining a high quality of customer service and customer satisfaction with products and services (Art. 6 sec. 1 lit. f GDPR).

3. When registering an account in the Online Store, the Customer provides:

• a) Entrepreneur's company name and VAT ID (NIP);
• b) e-mail address;
• c) company address details:
  • postal code and city/town;
  • street with house/apartment number.
• d) first and last name;
• e) company phone number.

4. When registering an account, the Customer independently sets an individual access password to their account. The Customer can change the password later, based on the rules described in § 7.

5. If subscribing to the Newsletter, the Customer provides their e-mail address or phone number — according to their choice.

6. If using the "ask about a product" service, the Customer only provides their e-mail address.

7. For Customer satisfaction surveys, TECHTAG processes the following data:

• a) e-mail address;
• b) order number.

8. While using the Store's Website, additional information may be collected, in particular: the IP address assigned to the Customer's computer or the external IP address of the Internet provider, domain name, browser type, access time, and operating system type.

9. To establish, pursue, and enforce claims, some personal data provided by the Customer within the Online Store functionalities may be processed, such as: name, surname, data regarding the use of services, if the claims arise from the way the Customer uses the services, and other data necessary to prove the existence of a claim, including the extent of the damage suffered. Legal basis: legitimate interest (Art. 6 sec. 1 lit. f GDPR), consisting in establishing, pursuing, enforcing claims, and defending against claims in proceedings before courts and other state authorities.

10. Providing personal data to TECHTAG is voluntary. However, failing to provide specific data in forms during registration prevents the creation of a Customer Account, and in the case of placing an order without registering an account — it prevents placing and processing the order.

§ 3 Who Is Data Shared With or Entrusted To, and For How Long?

1. The Customer's personal data are transferred to service providers used by TECHTAG to run the Online Store. Depending on contractual arrangements and circumstances, these providers either follow TECHTAG's instructions regarding the purposes and methods of processing these data (processors) or independently determine the purposes and methods of processing them (controllers).

• a) Processors. TECHTAG uses providers who process personal data solely on TECHTAG's instructions. These include providers of hosting services, accounting services, marketing systems, customer satisfaction survey systems, web analytics systems, and marketing campaign effectiveness analysis systems.
• b) Controllers. TECHTAG uses providers who do not act exclusively on instructions and determine the purposes and methods of using personal data themselves. These include electronic payment and banking service providers.

2. Location. Service providers are based in Poland.

3. Customer personal data are stored:

• a) If the processing is based on consent — until the consent is revoked, and after revocation for a period corresponding to the statute of limitations for claims that TECHTAG can raise and that can be raised against it. Unless a specific provision states otherwise, the limitation period is six years, and for claims for periodic benefits and claims related to running a business — three years.
• b) If the processing is based on contract performance — as long as it is necessary for contract performance, and after this time for a period corresponding to the statute of limitations for claims. Unless a specific provision states otherwise, the limitation period is six years, and for claims for periodic benefits and claims related to running a business — three years.

4. In the event of a purchase in the Online Store, personal data may be transferred to a courier company to deliver the ordered goods.

5. If the Customer chooses payment via the przelewy24.pl system, their personal data are transferred, to the extent necessary for processing the payment, to PayPro S.A. based in Poznań (60-327 Poznań, ul. Kanclerska 15), entered into the register of entrepreneurs under KRS number 0000347935, VAT ID 7792369887, REGON 301345068.

6. If the Customer subscribes to the Newsletter, TECHTAG will send electronic messages containing commercial information about promotions and new products available in the Online Store to their e-mail address.

7. If requested, TECHTAG provides personal data to authorized state authorities, in particular organizational units of the Prosecutor's Office, the Police, the President of the Personal Data Protection Office, the President of the Office of Competition and Consumer Protection, or the President of the Office of Electronic Communications.

§ 4 Cookies Mechanism, IP Address

1. The Online Store uses small files called cookies. They are saved by TECHTAG on the end device of the person visiting the Online Store if the web browser permits. A cookie file typically contains the name of the domain it comes from, its "expiration time," and an individual, randomly selected number identifying this file. Information collected using this type of file helps adjust the products offered by TECHTAG to individual preferences and the real needs of visitors. They also allow compiling general visit statistics for products presented in the Online Store.

2. TECHTAG uses two types of cookies:

• a) Session cookies: after the browser session ends or the computer is turned off, the saved information is deleted from the device's memory. Session cookies do not allow the downloading of any personal data or confidential information from Customers' computers.
• b) Persistent cookies: are stored in the memory of the Customer's end device and remain there until deleted or expired. Persistent cookies do not allow the downloading of any personal data or confidential information from Customers' computers.

3. TECHTAG uses its own cookies to:

• a) authenticate the Customer in the Online Store and ensure the Customer's session (after logging in), so the Customer does not have to re-enter their login and password on every subpage;
• b) analyze, research, and audit viewership, in particular to create anonymous statistics that help understand how Customers use the Store's Website, allowing the improvement of its structure and content.

4. TECHTAG uses third-party cookies to:

• a) present a map indicating the location of the TECHTAG office using the maps.google.com service (third-party cookie administrator: Google Inc based in the USA);
• b) collect general and anonymous static data via Google Analytics (third-party cookie administrator: Google Inc based in the USA);
• c) present ads tailored to the Customer's preferences using the Google AdSense internet advertising tool (third-party cookie administrator: Google Inc based in the USA).

7. TECHTAG may collect IP addresses of Customers. An IP address is a number assigned to the computer of a person visiting the Online Store by an Internet service provider. The IP number provides access to the Internet. In most cases, it is assigned to a computer dynamically, i.e., it changes with each connection. TECHTAG uses the IP address to diagnose technical problems with the server, create statistical analyses (e.g., determine which regions we record the most visits from), administer and improve the Online Store, ensure security, and potentially identify unwanted automated programs viewing the Online Store's content that heavily burden the server.

§ 5 Rights of Data Subjects

1. Right to withdraw consent — legal basis: Art. 7 sec. 3 GDPR.

• a) The Customer has the right to withdraw any consent given to TECHTAG.
• b) The withdrawal takes effect from the moment of withdrawal.
• c) Withdrawal of consent does not affect processing carried out by TECHTAG lawfully before the withdrawal.
• d) Withdrawal of consent has no negative consequences for the Customer but may prevent further use of services or functionalities that TECHTAG can legally provide only with consent.

2. Right to object to data processing — legal basis: Art. 21 GDPR.

• a) The Customer has the right to object at any time — for reasons related to their particular situation — to the processing of their personal data, including profiling, if TECHTAG processes data based on a legitimate interest, e.g., marketing TECHTAG products and services, keeping statistics on the use of particular Online Store functionalities, facilitating the use of the Online Store, and satisfaction surveys.
• b) Unsubscribing via e-mail from marketing communications means the Customer objects to processing their personal data, including profiling for these purposes.
• c) If the objection turns out to be valid and TECHTAG has no other legal basis for processing the data, the personal data the Customer objected to will be deleted.

3. Right to erasure ("right to be forgotten") — legal basis: Art. 17 GDPR.

• a) The Customer has the right to request the deletion of all or some personal data.
• b) The Customer has the right to request erasure if:
  • the data are no longer necessary in relation to the purposes for which they were collected or processed;
  • they withdraw the specific consent on which processing was based;
  • they object to the use of their data for marketing purposes;
  • the personal data have been unlawfully processed;
  • the personal data must be erased for compliance with a legal obligation in Union or Member State law to which TECHTAG is subject;
  • the personal data were collected in relation to the offer of information society services.
• c) Despite the request for erasure, TECHTAG may retain certain personal data to the extent necessary to establish, exercise, or defend legal claims, or to comply with a legal obligation. This applies particularly to data such as: name, surname, e-mail address — retained for handling complaints and claims related to TECHTAG services, or residence/correspondence address, order number — retained for handling complaints and claims related to concluded sales agreements or service provision.

4. Right to restriction of processing — legal basis: Art. 18 GDPR.

• a) The Customer has the right to request the restriction of processing their personal data. Submitting a request prevents the use of certain functionalities or services that involve processing the data covered by the request until it is processed. TECHTAG will also not send any communications, including marketing ones.
• b) The Customer has the right to request restriction of processing in the following cases:
  • when they contest the accuracy of personal data — TECHTAG restricts its use for a period enabling the verification of accuracy, no longer than 7 days;
  • when processing is unlawful and the Customer opposes the erasure of data, requesting restriction instead;
  • when data are no longer needed for the purposes they were collected or used, but the Customer needs them to establish, exercise, or defend legal claims;
  • when they have objected to the use of their data — restriction occurs for the time needed to verify whether the legitimate grounds of the Administrator override those of the Customer.

5. Right of access — legal basis: Art. 15 GDPR.

• a) The Customer has the right to obtain confirmation from the Administrator as to whether personal data concerning them are being processed, and, where that is the case, the right to:
  • access their personal data;
  • obtain information about processing purposes, categories of processed personal data, recipients or categories of recipients, the envisaged storage period or criteria used to determine it, the Customer's rights under the GDPR, the right to lodge a complaint with a supervisory authority, the source of data, automated decision-making (including profiling), and safeguards used when transferring data outside the European Union;
  • obtain a copy of their personal data.

6. Right to rectification — legal basis: Art. 16 GDPR.

• a) The Customer has the right to obtain from the Administrator without undue delay the rectification of inaccurate personal data concerning them. Taking into account the purposes of processing, the Customer has the right to have incomplete personal data completed, including by providing a supplementary statement, by sending a request to the e-mail address according to § 8 of this Policy.

7. Right to data portability — legal basis: Art. 20 GDPR.

• a) The Customer has the right to receive their personal data provided to the Administrator and then transmit those data to another selected data controller. The Customer also has the right to have the personal data transmitted directly from the Administrator to another controller, where technically feasible. In this case, the Administrator will send the Customer's personal data as a CSV file.

8. Should the Customer exercise any of the above rights, TECHTAG fulfills the request or refuses to fulfill it immediately, but no later than within one month after receipt. However, if — due to the complexity of the request or the number of requests — TECHTAG cannot fulfill the request within a month, it will fulfill it within the next two months, informing the Customer in advance about the intended extension and its reasons.

9. The Customer may submit complaints, inquiries, and requests regarding the processing of their personal data and the exercise of their rights to the Administrator.

10. The Customer has the right to request from TECHTAG a copy of the standard contractual clauses by submitting an inquiry as specified in § 8 of this Policy.

11. The Customer has the right to lodge a complaint with the President of the Personal Data Protection Office regarding any infringement of their right to personal data protection or other rights granted under the GDPR.

§ 6 Services Tailored to Preferences and Interests (Profiling)

1. Profiling means any form of automated processing of personal data consisting of using personal data to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects concerning that person's economic situation, personal preferences, interests, reliability, behavior, or location.

2. Customers' personal data may be processed in an automated manner (profiling); however, this will not produce any legal effects concerning them or similarly significantly affect their situation.

3. Profiling of personal data by TECHTAG involves processing Customer data automatically and manually to evaluate certain information about the Customer, in particular to analyze or predict their personal preferences and interests.

4. In order to reach the Customer with marketing communications outside the Online Store's Website, TECHTAG uses the services of external providers. These services display marketing communications on websites other than the Online Store's Website. To do this, external providers install an appropriate code or pixel to retrieve information about the Customer's activity on the Online Store's Website. Details on cookies used are in § 4. Legal basis: legitimate interest (Art. 6 sec. 1 lit. f GDPR), consisting of tailoring marketing communications to preferences and interests.

5. In order to reach the Customer with marketing communications via the Online Store's Website, TECHTAG uses the services of external providers displaying marketing communications on the Online Store's Websites. Legal basis: legitimate interest (Art. 6 sec. 1 lit. f GDPR), consisting of tailoring marketing communications to preferences and interests.

§ 7 Security Management — Password

1. TECHTAG provides Customers with a secure and encrypted connection when transmitting personal data and logging into the Customer Account on the Website. TECHTAG uses an SSL certificate issued by one of the leading companies in the field of security and data encryption on the Internet.

2. If a Customer with an account in the Online Store has lost their access password, the Online Store allows the generation of a new password. TECHTAG does not send password reminders. The password is stored in an encrypted form, making it impossible to read. To generate a new password, the Customer should provide their e-mail address in the form available under the "I forgot my login or password" link near the login form.

3. TECHTAG never sends any correspondence, including electronic correspondence, asking for login details, and particularly the access password to the Customer's account.

§ 8 Changes to the Privacy Policy

1. The Privacy Policy may change, of which TECHTAG will inform Customers 7 days in advance and will post appropriate information on the Online Store's website.
